Petersen MFG. Co. Inc. CAD Drawing and Specifications License Agreement

IT IS ESSENTIAL THAT YOU READ THE FOLLOWING TERMS AND CONDITIONS BEFORE ACCESSING THE CAD DRAWINGS AND SPECIFICATIONS CONTAINED WITHIN THIS WEB SITE. USE OF THIS INFORMATION AS WELL AS ALL INFORMATION OTHERWISE CONTAINED WITHIN THIS WEB SITE SIGNIFIES YOUR ACCEPTANCE OF THE FOLLOWING TERMS AND CONDITIONS FOR ALL CURRENT AND SUBSEQUENT USE OF THIS MATERIAL. IF YOU DO NOT AGREE WITH THE FOLLOWING LICENSING AGREEMENT AND TERMS PLEASE EXIT IMMEDIATELY.

Petersen MFG. Co. Inc. (Petersen MFG.) grants the following license to use the following drawings and specifications without exclusivity upon acceptance of these terms and conditions. The drawings and specifications do not alter the copyright, patent, trademark, or any other intellectual property rights belonging to Petersen MFG., nor do such rights convey to the user.

A. The drawings and specifications may be used in any conventional format as part of general specifications or drawings for the preparation of project details, conceptual documents, estimates, client preparation materials, etc., as long as all references to the source are retained in final documents and all patent, trademark, and or copyright attribution is retained.

B. The license to use these drawings specifically excludes the transfer of such material for the purpose of preparing imitation, competing or other products in competition with the source.

C. Any distribution, copying or other use of these materials without the express written consent of Petersen MFG. is not permitted under the terms of this license and will void this license.

D. All drawings and specifications are presented as copyright protected, with all rights reserved. Further, the drawings are the property of Petersen MFG. and the patents, patents pending, trademarks, etc., wherein represented, are covered by the laws of the country or countries in which such patents, patents pending, or trademarks have been filed with appropriate government agencies.

E. The contents of this Web site are provided "AS IS". Under no circumstances shall Petersen MFG. be liable for any incidental, special or consequential damages that result from the use or inability to use the contents of this Web site.

F. You further agree that should any action be brought against you or your principal for violation of any terms of this agreement and license, you and your principal will pay to Petersen MFG. the reasonable attorney fees and costs it incurred in enforcing its rights. You further agree that any such action against you or your principal may be brought in any court in Iowa, USA. You further agree that any violation of this agreement and license by use of the copyrighted drawings and images of Petersen MFG. and/or propriety rights of Petersen MFG. cannot be adequately remedied by the payment of money damages and that immediate, irreparable harm will come to Petersen MFG. by the continued possession of the drawings and images in your hands or your principal’s hands following any violation of this agreement and license. Consequently, you agree that Petersen MFG. would be entitled to injunctive relief against you and your principal to halt any sales or delivery of products based upon the use of the contents of this Web site in violation of this agreement and license.

G. Upon accepting the terms and conditions of this agreement by accessing the drawings and specifications, you and your principal agree to the above terms and conditions and are bound by them. Accepting these terms acknowledges that you understand such terms and conditions and that you are agreeing to them on behalf of yourself and your principal.
